CDA Orders Sealing of Nilore Homes Offices Over Unapproved Development

The Capital Development Authority (CDA) has ordered the sealing of the marketing and site offices of Nilore Homes on Lehtrar Road after determining that development activities were being carried out without the approvals required under applicable regulations.

The action was taken after the authority found that the housing scheme had started development work without securing approval of its Layout Plan or obtaining the necessary No Objection Certificate (NOC).

According to a CDA document, the authority considered the development, construction and use of land at the scheme to be in violation of the legal and regulatory framework governing private housing schemes in Islamabad.

The CDA cited provisions of the CDA Ordinance 1960, ICT Zoning Regulations 1992 and other applicable regulations while taking action against the housing scheme.

The authority said the scheme’s sponsors had already been warned about the violations through notices and show cause notices. Despite these directions, the required approvals were reportedly not obtained.

The sponsors had previously been instructed to immediately stop development activities at the scheme. They were also directed to halt marketing, sale and purchase of plots, as well as plot allotments and transfers.

In addition to stopping commercial activities, the sponsors were ordered to remove or demolish buildings and other structures that had been constructed in violation of the applicable regulations.

The latest CDA action indicates that the authority has moved toward enforcement after the sponsors failed to comply with the earlier directives. Sealing the marketing and site offices effectively restricts the scheme’s ability to continue its on-site and promotional activities through those offices.

Housing schemes operating without regulatory approvals can create significant risks for prospective buyers. Approval of the Layout Plan and issuance of the required NOC are important steps in establishing whether a private housing scheme has received authorization to proceed with development.
